Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://www.callgenieUSA.com website (the “Service”) operated by callGenieUSA LLC. (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
The Service and its original content, features and functionality are and will remain the exclusive property of callGenieUSA LLC. and its licensors.
Our Service may contain links to third-party web sites or services that are not owned or controlled by callGenieUSA LLC
callGenieUSA LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that callGenieUSA LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
These Terms shall be governed and construed in accordance with the laws of United States of America and Canada without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
We provide you the customer with access to select the best shipping method for you. The shipping method via the web shop is USPS priority mail (est 3-5 days). However, you may provide a prepaid shipping label (FedEx, UPS, etc) for the order and we will refund the calculated shipping on the order. Should you fail to insure the callGenie package we ship out using your selected service/carrier, we will not be responsible for your loss after we have transferred the package ot the carrier. We will provide shipping notification with the information from your selected shipping method/service proving that we transferred the callGenie package to the selected service.
The callGenie customer must make reasonable effort(s) to be available for installation and any troubleshooting on an as needed basis. If customer does not provide sufficient availability of someone on site with the ability to plug, unplug, take and send pictures, report accurately TV operation, and position a Skype phone camera as requested by installer/technician, the customer forfeits access to the return policy. callGenieUSA will make best effort to work with customers and their availability but lack of access to the callGenie device with customer or customer representative on site is untenable.
As long as we have checked the end-user’s television for compatibility prior to an order being placed, you will get a full refund if we can’t get your CallGenie device working with the end user’s television, for any reason except lack of "Reasonable Access to device" as listed above.
To get your refund you must return the CallGenie Appliance within 30 days of purchase, unless agreed otherwise, in the same condition as it was delivered to you. This includes placing everything back in its original packaging. If anything is missing, including any internal packaging or instruction leaflets, there will be a deduction made to recover our costs, as those parts will not be suitable for re-use in another appliance.
Please note:
Refunding of Appliances that have not been opened or installed
(1) The components that make up the CallGenie Appliance must have remained in their original packaging and not have been taken out and assembled.
Refund Policy (Also applies to discount credit where applicable)
For approved refunds we will process a credit to the original credit card used. We do not guarantee the timing of this credit as we use an external vendor/service as part of the web services that we procure. In the event of a service issue processing the refund, resolution of the service issue will precede the refund as it is not within our ability to bypass the payment service. We strongly suggest that the purchaser maintain the original payment method if there is any possibility of a refund or credit.
Order Cancellations
If the order does not have the correct shipping address, or the order does not have the configuration the customer specifies in verbal, written, or electronic communication we will cancel the order. The refund timing is under the control of the web shop software and operator which we generally understand that cancellation earlier equates to the refund processing to be completed earlier. The refund process is not under callGenieUSA's control. We can provide transaction number, approval or authorization number, and respective date, but we do not have any other form of financial tracking to monitor the refund process between the underlying web shop merchant, credit card processor, clearing house, and or bank(s).
